Terms & Conditions


Please read through these terms and conditions before placing your order. They do not affect your statutory rights. Placing an order with Hometown Furniture ltd constitutes your agreement to be bound by these terms and conditions.


Hometown Furniture Ltd. reserves the right to change these terms and conditions from time to time without notice to you and any changes will take immediate effect on the day they are posted. You will be requested to read and accept these terms and conditions every time you place an order. For this reason we encourage you to review them whenever you use this website to ensure that you are familiar with the latest terms and conditions.

How the contract is formed between you and us

After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the product/s are ready for dispatch. The contract between us will only be formed when we send you the ”Order Confirmation.”
The Contract will relate only to those products whose dispatch we have confirmed in the “Order Confirmation.” We will not be obliged to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate “Order Confirmation.” We will only deliver complete orders unless otherwise agreed by ourselves.


Consumer rights

If you are contracting as a consumer, you may cancel a Contract at any time within seven working days, beginning on the day after you received the products. In this case, you will receive a full refund of the price paid for the Products in accordance with our refunds policy..
To cancel a Contract you must inform us in writing. You must also return the products to us as soon as reasonably practicable and at your own cost. You have a legal obligation to take reasonable care of the products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

You will not have any right to cancel a contract for the supply of any of the following products:

• Bespoke or made to measure furniture.

Details of your statutory right of cancellation, and an explanation of how to exercise it, are provided in the “Dispatch Confirmation.” This provision does not affect your other statutory rights as a consumer.
Availability and delivery

Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation or, if no delivery date is specified, then within a reasonable time of the date of the Dispatch Confirmation, unless there are exceptional circumstances.
Risk and title

The Products will be at your risk from the time of delivery. When at street side.

Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.
Price and payment

The price of the products and our delivery charges will be as quoted on our site, except in cases of obvious error.

Product prices include VAT.

Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

 

Payment for all products must be by credit or debit card in pound sterling. We accept payment with all major credit and debit cards with the exception of American Express. We will charge your credit or debit card at time of placing the order.

Our refunds policy

Returning a product to us: because you have cancelled the Contract between us within the seven-day cooling-off period (see clause above), we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you gave notice of cancellation. In this case, we will refund the price of the product in full, and any applicable delivery charges. However, you will be responsible for the cost of returning the item to us.
For any other reason (for instance, because have notified us in accordance with the above clause that you do not agree to a change in these terms and conditions or in any of our policies, or because you consider that the Product is defective), we will examine the returned Product and will notify you of your refund via e-mail within a reasonable period of time. We will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via e-mail that you were entitled to a refund. We will refund the price of a defective Product in full, any applicable delivery charges will not form part of the refund.


Warranty

We warrant to you that any product purchased from us through our site will, on delivery, conform in all material in respect of the description, be of satisfactory quality, and be reasonably fit for all the purposes for which products of that kind are commonly supplied and used for.

 VAT


All of our quoted prices are inclusive of VAT at the prevailing rate, however adjustments will have to be made to comply with any change in rates or other legally imposed changes in respect of VAT.

Delivery

Based on the size of and contents of your order, we will decide the best delivery method for you. You will receive one of three delivery types. Details of each delivery type are listed below.  Not certain what delivery type you’ll get? We’ll be able to say when you take your furniture to the checkout.

Standard Delivery

Delivered by our expert delivery team

Delivery to the front entrance on the ground floor of your property.

Delivery between  6.00 am and 6.00 pm

Room of Choice Delivery

Delivered by our dedicated two-person delivery team.

Your furniture will be carried to the room of your choice, access permitting.

White Glove including Assembly

Our specialist delivery team will take your furniture to your room of choice, unpack, assemble and position your furniture. The price for assembly depends on what you have ordered.

Silver
assembly covers all small items including coffee tables, console tables, dressing tables. Will be charged at £45 per delivery.
Silver multi item
This service is for furniture items described above and would cover up to three items for assembly. Will be charged at £65
Gold
assembly covers all larger items like wardrobes, beds, tables, bookcases (where required) and display cabinets. Will be charged at £55 per delivery.
Gold multi item
This service is for furniture items described above and would cover up to three items for assembly. Will be charged at £85

 

 
Storage


Unfortunately we do not have the facility to store your product for any length of time therefore if you cannot take the product within two weeks of us advising you of its availability, we will charge storage charges of £25 per week for a maximum of four weeks, after which we deem the order to be cancelled.


Disposal of old furniture 
 

We cannot collect or dispose of your old furniture. However we ask that you do not dispose of your old sofa, table or bed if at all possible until delivery has been made as, in the unlikely event of a delivery problem arising, we cannot guarantee a loan piece of furniture. 
 

Access


We will do our best to place the goods in the desired location, provided there is reasonable access. It is your responsibility to ensure that the product can be delivered into your home and into their chosen location. It is essential therefore that you discuss any possible restrictions on access into your home so that we can perform a risk assessment with you. You should think in particular about vehicle access, lifts and tight stairs etc. If windows or doors need to be removed in order for access to be gained it is your responsibility to arrange this at your cost and risk.


Colours and finishes


Photographs displayed on our website and display models and samples in our stores are representative of the finished product. Whilst every effort will be made to match all colours and finishes, goods are supplied on the understanding that there may be slight dye, shade and grain variations, particularly with natural products such as wood. Leather products are made from quality hides and may not be uniform in colour or texture and will show natural marks and scars.. Colours will be affected by your monitor and by your printer and therefore may not be 100% accurate to the finished product.


Size and description of product


All sizes quoted are approximate. Size and product descriptions are given in good faith from our suppliers' information. All our product sizes are displayed in millimeters in Width x Depth x Height. Products are manufactured to perform within the appropriate industry measurement tolerances.
Variation in product specification
Due to the shortage of certain new raw materials, changes in legislation or safety requirements some products supplied by the Company may have minor technical alterations and could differ slightly in actual construction from the goods shown in sample or pattern form. The Company state any changes that are made will result in a performance of an equally high or improved standard. The quality coding will remain the same and the quality guarantee will continue to apply.


Guarantee


All goods supplied are guaranteed by the manufacturer for a period of 12 months from date of delivery in respect of faulty workmanship or materials. Your statutory rights are unaffected.
General care
The product(s) supplied are to be used for the purpose and in the manner for which they were designed. Most manufacturers include care and maintenance advice with their products, which should be read and followed. No responsibility will be accepted for damaged caused by cleaning if the care and maintenance instructions have not been followed.

Made to Order Products/Bespoke


Made to order products, have been produced specifically for you, therefore no refunds or exchanges can be made after 7 days of placing your order unless there is an error on our part regarding the product specification, or the item is found to be faulty.

Cancellations by Hometown Furniture Ltd

We reserve the right not to accept an order if:
• We do not have the stock to fulfil the order
• If we are unable to deliver the product to your area
• If an item was incorrectly priced or described on the web site
• If your payment was not authorised
• If you have not complied with our terms and conditions of sale
• If an order is cancelled by Hometown Furniture Ltd., any payments made to us will be refunded within 30 days of the cancellation.
THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.
